What does the rent depend on?

The Housing Code of the Russian Federation has imposed the obligation to pay bills on the owner of the premises, the tenant or the tenant. The amount of rent depends on the following factors:

  • number of registered or owners;
  • tariff for the service.

What services are rent charged for?

The list of utilities can be divided into 2 large groups:

The first group includes about 70% of services and consists of hot and cold water, electricity, heat, etc. - that is, what a person consumes.

The utility payment is made up of the total amount of resources consumed. If meters are installed, the apartment owner will have to submit meter readings to the service provider company.

In the absence of meters, rent is calculated based on established standards, the amount of which depends on the number of registered persons.

The heating fee will be calculated based on the total area of ​​the room.

The second group of services that are necessary for the apartment, entrance, house and surrounding area to be serviced by a house management company. These include:

  • house maintenance;
  • drainage;
  • garbage removal;
  • maintenance of the local area.

Fees for these services are charged based on the total area of ​​the house.

Contributions for major repairs are calculated as a separate line. They are paid to the operator and calculated from the area of ​​the apartment.

The rent amount in the payment slip changes monthly, as meter readings vary. However, those columns that indicate services related to the area of ​​the premises remain unchanged.

Payment for services based on the prescribed amount

When the rent is calculated, the total amount is displayed on the receipt. In order to find out which of those prescribed should pay how much, you need to know how much resources he consumed per month. However, identifying this indicator is almost impossible.

The only possible option to find out how much to pay for one registered person is to divide the amount among all registered citizens. The resulting value will be everyone’s share.

If metering devices are installed, you can calculate the approximate consumption using the units indicated on them. But even in this case, disagreements may arise, since the meters show, for example, cubes of hot and cold water supply, while each registered one can use only a few liters.

Dependence of the payment amount on the number of people

Gas, electricity, water in the absence of metering devices will be calculated based on standards. To know how much the rent increases when a person registers, you need to multiply the existing indicators by the number of registered people.

Rent based on the number of residents or registered residents may be reduced if:

  • provided resources will be spent more economically;
  • the owner will install meters not only for gas and water, but also for heating and sewerage.

In addition, there are services, such as cleaning staircases, which are included in the “Housing Maintenance” column and depend on the number of residents; Therefore, the rent varies depending on the number of registered people.

Who should pay for what?

Art. 153 of the Housing Code of the Russian Federation establishes the obligation of the owner of living space to pay for utilities. Therefore, even if the owner does not live in the apartment, he must ensure that payments are made on time.

Does the rent change depending on the number of owners? No, if they are not registered in the apartment.

The Housing Code of the Russian Federation clarifies who exactly should make the payment:

  • premises owners;
  • tenants under a social tenancy agreement;
  • members of the housing cooperative;
  • a tenant of an apartment from a state or municipal fund;
  • a citizen who accepted an apartment under a share participation agreement in a construction site.

For the above persons, the obligation to pay arises from the moment the right arises (for example, concluding an agreement, receiving a certificate of ownership).

In practice, situations may arise when no one is registered in the apartment, no one lives, or the owner is in debt due to the fault of the tenants. Below we will consider each case in more detail.

If no one is registered

There are cases when the number of registered people in an apartment is zero, the owner of the apartment is not registered in it, and the living space itself is empty.

The recommendations are as follows: install electricity, gas and water meters. If possible, especially if no one plans to live in the house in the near future, you can also spend money on heating meters.

Since the apartment is empty, there will be no consumption of resources and, accordingly, accruals will also be made to a minimum.

We still recommend notifying the building management company that no one lives in the apartment and leaving a contact number in case of an unforeseen situation.

Registered, but no one lives

When several citizens are registered in an apartment, but no one lives, it is necessary to notify authorized persons so that there are no charges for rent.

The owner needs to visit the management company, organizations providing heat, gas and electricity services and perform the following actions:

  • write a statement that the premises are empty;
  • provide a document confirming temporary registration at another place of residence (this could be about military service, being in a colony, or a long business trip; in this case, you will need papers stating this fact).

For reference! The above procedure must be carried out once every 6 months.

How to force someone to pay?

How can I demand payment of utility bills from tenants? There are several options for this:

  • split personal account;
  • start a conversation about the end of temporary registration;
  • file a lawsuit.

The last two cases are typical only for situations where the apartment is rented. And the first is for those registered, but for citizens who contribute to the payment of services and do not know whether the number of registered persons affects the size of the rent.

As for filing a claim in court, before this the owner of the premises must pay all existing debts, provide payment to the court and only then demand compensation from the tenants, and then only if he proves that they were assigned such an obligation.

How do service providers deal with defaulters?

  • impose sanctions in the form of penalties;
  • turn off the supply of services;
  • go to court to collect debt or evict.

The bills that come to owners contain information about what fine will be imposed on them if payments are not received on time. If payment is not received, service providers warn the apartment owner that their supply will be cut off. If this measure does not work, a shutdown occurs.

When the debt for housing has exceeded all acceptable limits, the building management company and suppliers go to court to collect the debt.

This is a typical way to resolve a legal issue and, as a rule, the court does not side with the citizens. The exception is cases when people provide convincing evidence of the impossibility of paying for the service.

Another measure of influence on non-paying citizens is eviction. This mainly applies to those who live in an apartment under a social tenancy agreement. They are provided with less comfortable housing, for example, a communal apartment.

However, owners may also be affected by this measure, but they can only be evicted if there is another place to live. Otherwise, the debt will be collected through the sale of owned movable property.

Thus, the rent depends on the number of people registered only if the house does not have meters. It is also possible that the receipt contains services, the calculation of which takes into account the number of registered people.
