Land plots owned by citizens and enterprises under the right of ownership can act as an independent subject of a transaction. Restrictions on the disposal of land can only be established by regulatory legal acts.

When purchasing a plot of land, what documents are needed to draw up an agreement and subsequent registration actions? First of all, the parties need to check the documents certifying the seller’s right to sell the land plot.

They will include:

  • general civil passport of the owner of the allotment;
  • notarized power of attorney, if the transaction is entrusted to a representative;
  • title documents - certificate of title (if registration of rights was carried out before July 2016), extract from the USRN register (if registration actions were carried out since July 2016), certificate of inheritance, administrative act of local authorities on the provision of land ownership, etc. ;
  • cadastral passport (starting from January 2017, an extract from the Unified State Register of Real Estate is issued instead of this document);
  • a certificate from the cadastral authorities of Rosreestr confirming the absence of encumbrances on the site.

Documents for the purchased plot must be prepared by the owner, and all extracts from the Unified State Register must be current at the time of the transaction.

If there is a certificate of title for the plot, issued before July 2016, there is no need to change it to an extract from the Unified State Register of Real Estate, such a replacement will be carried out by the cadastral authorities when registering the transaction.

For the construction of individual housing construction, land is allocated from the state or municipal fund.

It is necessary to take into account that the formation of the site will have to be done by the citizens themselves at the stage of providing land for temporary use, and then during re-registration of ownership.

When purchasing a summer cottage plot, the purchaser has the right to request a list of documents confirming the registration of ownership of the seller.

This is due to the specific nature of such plots and buildings; for a long time, it was almost impossible or difficult to register rights to country houses and plots.

Since the seller needs a document confirming the property, he will have to properly register the dacha plot.

Until the end of 2016, as part of the dacha amnesty program, it was enough to submit a declaration for the property (dacha house) and a diagram of the location of the site on the territory of SNT. A document confirming that the dacha plot belongs to a citizen was issued by the SNT board and registered with Rosreestr institutions.

Since January 2017, the procedure has changed significantly - to register a plot, you must first obtain a boundary plan. It must be prepared by a cadastral engineer after surveying the land and establishing the boundaries of the plot.

Based on the results of these activities, the owner of the dacha plot will receive an extract from the Unified State Register of Real Estate, on the basis of which the documents for the sale transaction will be processed.

To register a land plot, you will need to submit the following documents:

  • application for the registration procedure;
  • civil passport of the copyright holder or power of attorney for a representative;

  • boundary plan with an act of approval of the boundaries of the allotment;
  • payment document confirming payment of the state duty.

If registration is carried out during the transaction, documents for re-registration of the land plot must be submitted by both parties.

If the rights are issued on the basis of the allocation of land from the municipal fund, an application from the owner of the site is sufficient.

How to check the authenticity of documents for the acquired land plot

When purchasing real estate, the buyer must check the legal purity of the transaction and the property itself that he plans to purchase.

In relation to land plots, the verification algorithm will consist of the following actions:

  • a confirming document for the right to dispose of land is required (a certificate of registration of a land plot or an extract from the Unified State Register of Real Estate will be the appropriate document for completing the transaction);
  • you need to obtain an extract from the Unified State Register of Real Estate with the main characteristics of the allotment (borders, area, etc.);
  • For verification, a document confirming the intended purpose of the land plot is also required (when selling land, the categories of plots and types of permitted use must be observed);
  • checking the legal purity of the transaction is impossible without obtaining a certificate from the Unified State Register of Real Estate (USRN) confirming the absence of restrictions and encumbrances on the right (for example, a pledge obligation).

In most cases, the buyer can contact the Rosreestr office himself to obtain the necessary extracts and certificates, since the main principles of the functioning of the real estate register are openness and accessibility to the public.

The buyer may also require the submission of a certificate of previously registered rights to this plot.

Since such papers can only be obtained by the owner of the property, the seller will have to contact the Rosreestr service or the MFC.

This extract will allow you to trace the entire chain of transactions on the plot from the moment it is registered with the cadastral authorities.

Stages of purchasing land

Contacting the registration authorities will be the final stage when purchasing land. This procedure can be represented in the following steps:

  • searching for counterparties, agreeing on essential and optional terms of the transaction;
  • checking the legal purity of real estate and transactions;
  • preparing and filling out a written form of purchase and sale agreement;
  • contacting a notary office to certify the agreement if the land plot is in shared ownership;
  • submission of documents to the Rosreestr institution or MFC for registration actions.

Ownership will be recorded in the Unified State Register of Real Estate, after which the new owner will receive a title document - an extract from the register.
