Queue for a land plot for large families - a package of documents and a place in the queue
Content
The legislation provides for many social benefits and guarantees aimed at supporting families with three or more children. Among other things, a large family has the right to count on a plot of land for the construction of a private house; to do this, it is necessary to submit documents to the local administration and stand in line for the allocation of land.
Requirements for provision of land
A large family is a family raising three or more minor children. The legislation establishes that in order to obtain the status of a large family, not only natural children, but also children adopted in the prescribed manner are taken into account.
The opportunity to obtain a plot of land for such families appeared relatively recently; amendments to the law were made only in 2011.
Despite the fact that this benefit was introduced at the federal level, the conditions for obtaining a free plot of land for large families largely depend on regional and local regulations.
You can get on the waiting list for a land plot if you comply with the following legal requirements:
- the family must be officially recognized as in need of improved housing conditions;
- spouses must be in a registered marriage;
- the family must have at least three children under the age of 18;
- all family members must be registered at the same address;
- at least one of the parents must live for at least five years in the place of proposed land allocation.
The provision of this benefit to a large family is carried out once, and when submitting an application for placement in the queue, it is necessary to indicate the absence of an application for the allocation of land in the previous time.
You can get in line to receive a land plot at the local administration, which owns the municipal land fund. In this case, it is necessary to comply with the legal requirement regarding the minimum required period of residence in the specified area.
To confirm the status of a large family, as a rule, it is enough to provide a birth certificate for each child (or a passport if the children have reached the age of 14).
Nevertheless, local regulations may provide for the provision of a certificate of large families. Such a document confirming that you are a large family can be obtained from the social protection authorities or the local administration.
Since 2015, the law allows for the provision of an apartment to a large family instead of a plot of land, while the grounds for placing on the waiting list are approximately the same.
If applicants see that the prospect of obtaining land in the near future is very vague, they can apply for housing on social rent terms.
To do this, you need to confirm the need for improved housing conditions, as well as the status of a low-income family. The determination of need depends on regional standards for the provision of housing, and the income of low-income families is calculated based on the cost of living indicators.
What documents need to be provided
A family will be placed in line to receive land plots only upon presentation of a mandatory set of documents. The list of documentation includes:
- application for obtaining a land plot and queuing for land allocation;
- parents’ passports and children’s birth certificates;
- an extract from Rosreestr confirming that the applicants have not previously used the specified benefit;
- a document confirming a period of residence in the area of at least five years;
- a certificate or certificate confirming having many children;
- extracts from the Unified State Register of Real Estate on the presence or absence of real estate in the family, including land plots;
- an extract from a personal account or house register confirming the registration of applicants at the same address.
How to correctly write an application for a land plot? You must first study the list of land plots offered by the local administration for allocation to preferential categories of citizens.
The fact is that this preferential program often provides land plots that do not have the necessary infrastructure or are located in hard-to-reach places.
An application for a land plot for large families must contain the following items:
- the applicant’s passport details and contact details;
- the address of receipt of the land plot, as well as information about the cadastral quarter (this data can be found from the list of plots posted on the official portals of local authorities);
- the content of the request for the allocation of a plot for the construction of a private house;
- date and signature of the applicant.
An application for a land plot for a large family is submitted to the local government authority authorized to manage the lands of the municipal fund.
How to get on the waiting list to receive a plot of land
To get in line for a land plot, large families must first collect a complete set of documents listed above.
One of the possible reasons for refusing to satisfy an application will be an incomplete set of documentation.
The algorithm of actions for queuing up for the allocation of land plots to large families consists of the following stages:
- collection of necessary documents and selection of the territory for receiving the land plot;
- filling out an application and submitting it to the authorized government body;
- verification of submitted documents;
- making a positive decision on including a large family in the queue for the allocation of land for development.
It must be borne in mind that submitting an application does not mean that citizens will receive land within a few days. Land resources of local authorities are often limited for objective reasons.
In addition, the law currently prohibits the allocation of areas that are not equipped with the necessary infrastructure. Large families have the right to refuse such land.
Possible reasons for refusal
Improvement of living conditions for large families, that is, the allocation of land for development, may be denied if the following grounds exist:
- violation of the procedure for submitting documents - incompleteness or unreliability of certificates and forms, as well as information in the application;
- inaccurate information about family composition (for example, the presence of children over 18 years of age on the list);
- a change in the family’s place of residence, which deprives them of the right to receive land in a given area.
If the specified grounds are absent, the family will be put on a waiting list for the allocation of a plot for building a house.
An unlawful refusal to consider and satisfy an application may be appealed in court. Also, local regulations allow for the elimination of identified violations at the stage of verification of the application and submitted documents. If the court decision recognizes the illegality of the refusal, the family will be put on a waiting list from the date of filing the application.
